Ukraine ex-PM Tymoshenko moved to remote prison (Reuters)

KIEV (Reuters) ? Former Ukrainian Prime Minister Yulia Tymoshenko, sentenced to seven years in prison for abuse of office, has been moved to prison from a detention centre where she has been held since early August, the state penitentiary service said on Friday.

Tymoshenko's transfer to a remote location suggests she is unlikely to go free any time soon despite pressure from the European Union, which called her trial politically motivated. The EU put off the signing of a major trade and political agreement with Ukraine this month over the case.

Tymoshenko is the fiercest opponent of President Viktor Yanukovich, who narrowly beat her in a presidential run-off in February 2010.

She served as prime minister after helping to lead the 2004 "Orange Revolution" protests, which overturned an election victory for Yanukovich in his first bid for the presidency.

A court sentenced Tymoshenko to seven years in prison in October, saying she had exceeded her powers when forcing through a 2009 gas deal with Russia as prime minister. Tymoshenko denies wrongdoing. She lost an appeal against the verdict a week ago.

"Tymoshenko has been moved to a prison in the Kharkiv region," the state penitentiary service said in a statement.

The prison is located about 500 kilometers (300 miles) away from the capital Kiev where Tymoshenko had been in detention and where her supporters held regular rallies.

The European Union, which had planned to initial agreements on political association and free trade with Ukraine at a summit this month, put off the signing and cited Tymoshenko's case as an example of selective justice in the former Soviet republic.

"The EU reiterates its concern about the risks of politically-motivated justice in Ukraine, of which the Tymoshenko trial is the most striking example," a spokesman for EU Foreign policy chief Catherine Ashton said on Friday.

"Given the strong international concern already surrounding this case, we call on the authorities to ensure that decisions on the detention conditions of Mrs Tymoshenko are taken transparently and in line with relevant international standards. The EU is urgently seeking further clarification from the Ukrainian authorities."

Yanukovich has refused to intervene and the parliament, dominated by his supporters, has turned down several proposals to remove her offence from the criminal code.

On Friday, Yanukovich issued a decree cancelling Freedom Day celebrations on November 22, a holiday introduced in 2005 to mark the "Orange Revolution" anniversary, provoking angry reaction from Tymoshenko's Batkivshchyna party.

It said in a statement that moving Tymoshenko to a prison and cancelling the holiday on the same day was "an act of final, cynical and public destruction of the ideals of democracy, freedom and independence."

Tymoshenko's lawyers say she hopes the European Court for Human Rights, where she has filed a case against Ukraine, will exonerate her. The court said this month it would fast-track the case.

Tymoshenko, 51, has been suffering from back pains in the last few weeks and cannot walk, according to her lawyers who have said she should not be moved from the detention centre on health grounds.

But the penitentiary service said she was fit to move.

"Before departure, Tymoshenko was examined by doctors who stated that her health allowed her to be moved," it said, adding that Tymoshenko travelled in a "comfortable" van.

This February, pianist Myra Melford, bassist Mark Dresser and drummer Matt Wilson will celebrate the release of The Guest House (Enja/Yellowbird), their second recording as Trio M, with California performances at the Athenaeum Music & Arts Library in La Jolla (2/2), the Jazz Bakery Series at Musicians Institute in Los Angeles (2/3) and Yoshi?s in San Francisco (2/6).

The record, which officially hits the streets earlier that week, features compositions by all three musicians, including pieces inspired by such diverse muses as the poetry of Rumi and Al-Jawahiri, the prose of Yvonne Vera, the comedy of Don Knotts and the music of Albert Ayler. Also included are selections written for the band?s 2010 collaboration with chef Paul Canales and a benefit concert for The Relay For Life, which celebrates lives affected by cancer.

Amid bloodshed, Hamas prepares to leave Syria

(AP) ? Alarmed by bloody unrest in Syria, the Hamas militant group has pulled out many of its lower-level cadres from its Damascus headquarters and made contingency plans to move its leadership to locations across the Middle East, senior Hamas members have told The Associated Press.

The Hamas members say the group remains appreciative of Syrian leader Bashar Assad and there is no immediate intention to abandon their base in Damascus. But they confirmed that dozens of low and midlevel members have already left Syria as the security situation grows increasingly precarious.

"Most of Hamas has left Damascus. We have a plan B for leaving if things deteriorate," said a senior Hamas official, who spoke on condition of anonymity because he was discussing the inner workings of the secretive group.

Hamas, an Iranian-backed Palestinian group, has been based in Syria for more than a decade. Assad has allowed Hamas, branded a terrorist group by Israel and the West, to use his territory for military training, and provided a valuable headquarters in the heart of the Arab world.

But the uprising in Syria has put Hamas in a difficult place. The U.N. estimates that more than 5,000 people have been killed in violence since March, and Hamas is wary of being associated with the government crackdown.

If Hamas does pull out completely, the move could force it to change the way it operates since the leaders would become dispersed across the region and their new hosts may not give them as much freedom. Hamas' supreme leader, Khaled Mashaal, for instance, is set to go to Qatar, a Gulf state with close ties to the U.S. Other leaders would go to Egypt, another American ally, while others would end up in Lebanon, Turkey or the Hamas-run Gaza Strip.

Fawzi Barhoum, a Hamas leader in the group's Gaza stronghold, says Hamas "hopes that Syria will get out of its difficult internal crisis through a political solution ending further bloodshed in the country." He said there has been "no decision" to leave Damascus.

The plan is the latest sign of change in the Islamic group amid the convulsions of the Arab Spring across the Middle East the past year. The uprisings have been a mixed blessing for Hamas. On one hand, allies like Syria are in trouble. On the other hand, Islamic groups have made strong gains through peaceful elections. While Hamas leaders say they haven't abandoned their dream of destroying Israel, they also seem to be realizing that they can advance their agenda through nonviolent means.

In recent days, Mashaal said Hamas would turn focus on nonviolent protests against Israel, though he refused to renounce violence.

He also signaled that Hamas might be willing to accept a Palestinian state alongside Israel in the West Bank and Gaza Strip, the areas captured by Israel in the 1967 Mideast war. Hamas has in the past endorsed the 1967 lines as the first stage toward eliminating Israel.

Hamas also last week began the process of joining the Palestine Liberation Organization as it reconciles with the rival Fatah movement. The Fatah-dominated PLO has long sought a political settlement with Israel. Joining the PLO could give Hamas a voice, and possibly veto, in future peace efforts.

Israeli officials dismiss any suggestion that Hamas, which has killed hundreds of Israeli civilians in suicide bombings, rocket attacks and other violence, has changed. They cite the hardline speeches delivered at Hamas' 24th anniversary celebrations earlier this month, when speakers proudly called for "armed resistance" and the destruction of Israel.

"Unfortunately there is no evidence that Hamas has in any way moderated its extremist agenda," said government spokesman Mark Regev.

Barhoum said the group has not abandoned its ideology. Instead, he said it has merely changed its tactics as it adjusts to the times.

"There is a new environment around us," he said. "That doesn't mean Hamas is giving up its rights and its clear program as a resistance faction."

Hamas began its transformation into a political movement in 2006, when it defeated Fatah in Palestinian legislative elections in the West Bank and Gaza Strip.

A brief power-sharing arrangement disintegrated into violence the following year, leaving Hamas in control of Gaza and the Fatah-dominated Palestinian Authority in charge of the West Bank. The sides are now holding reconciliation talks and hope to hold new elections next year.

In Gaza, Hamas on Tuesday marked the third anniversary of an Israeli military offensive in the seaside strip. The offensive, launched in response to months of intense rocket barrages, killed some 1,400 Palestinians, including hundreds of civilians, and caused widespread damage. Thirteen Israelis also died in the fighting.

At memorial ceremonies, speaker after speaker voiced their support for continued armed confrontation with Israel. After suffering heavy losses in the fighting, Hamas has largely maintained a cease-fire with Israel the past three years. Still, it is believed to have restocked its arsenal with more powerful weapons.

But Raed Nearat, a political science professor in the West Bank who is close to Hamas, said that behind the rhetoric, Hamas is in the midst of a significant change.

He said the revolutions across the Middle East, as well as elections that have voted heavily in favor of Islamic movements in Egypt, Tunisia and Morocco, have emboldened Hamas.

"The Arab Spring has made Hamas much more confident, pragmatic and open," he said. "It's much more confident now that it can lead."

This week, the prime minister of the Gaza government, Ismail Haniyeh, left the territory for the first time since the 2007 takeover on an official tour of the Muslim world. His first stop was Egypt, with planned visits to Sudan, Qatar, Bahrain, Tunisia and Turkey.

Hamas officials say the goal of the trip is to improve ties with Muslim countries swept up in the uprisings shaking the Arab world. In Egypt, Haniyeh met with the leader of Egypt's Muslim Brotherhood, the biggest winner in the first parliamentary elections since the Feb. 11 fall of Hosni Mubarak.

Get to Know One of Disc Golf's Best: Nikko Locastro

Nikko Locastro is one of the best disc golf players in the world, and he's currently up for the 2011 "Player of the Year" award, along with David Feldberg, Nate Doss, Paul Ulibarri, Paul McBeth, Will Schusterick and Josh Anthon.

He's had a great year, and hopes to make 2012 even better. On a recent blog posting, Locastro said he's been gearing up for next year, and in the off season he's been working on his custom designs, practicing and working out. He's been involved in creating a full range of NLDG (Nikko Locastro Disc Golf) custom art on discs, and has over 25 designs that are "in the works." His site already has some amazing custom designed t-shirts for sale as well.

Locastro said he has plans to really try and spread the word about disc golf, and hopes to do a lot more demonstrating. He comments, "I love the feeling of helping someone make improvements. This is something that I will do a lot more in the future." He also stated that, "Disc Golf is on an up rise and will continue to grow." I couldn't agree more, and Locastro's talents are a big part of it.

Locastro says in regard to the upcoming year, "I know with a good work ethic and routine I can continue to develop skills on and off the disc golf course. I do not want to look back in 2013 thinking I should have worked harder." Somehow I have a feeling that won't happen.

This year, he's played in 33 tournaments throughout the U.S. as well as internationally, and he's been the winner in 16 of them. That's a pretty amazing feat, and he's just 23 years old. Nikko's been playing disc golf for eight years, and has made big strides during that time.

In 2004, he placed fifth in the under 16 boys division at the Wisconsin Junior Championships, and had a seventh place finish in the advanced division at the Gateway Open four months later in his hometown of St. Louis, Missouri. The following year, Locastro was the advanced division winner at the St. Louis Spring Sizzler and had a fifth place finish in the same division at the St. Louis Open. He was victorious in that event in 2006.

2006 was also the year Locastro began competing in the open division, and he was the winner of both the Capital City Challenge and the Let's Do It Again. 2007 and 2008 saw him accomplish even more, and he took home more victories in the open division, including the Illinois Open in September 2008.

Locastro really took off in 2009, winning the United States Disc Golf Championship, the National Tour Series and much more. In 2010, he won the Japan Open, the Stockholm Disc Golf Open in Sweden and the Vibram Open, among many others. At the World Championships, he had an impressive sixth place finish.

Each year has continued to see Locastro become even more successful. Just some of his wins in 2011 include the National Tour Series, the Stockholm Open, the Texas State Disc Golf Championships and the Veterans Park Open. He had an impressive fourth place finish at the Professional Disc Golf World Championships this summer as well.

The odds are, he will accomplish even more in 2012. Congratulations to Nikko Locastro and the excellent job on making a great sport that much better.

Windows Phone Marketplace hits 50,000 app-submission milestone

Just over one month after crossing the 40,000 app-submission threshold, Microsoft's Windows Phone Marketplace has hit another milestone: 50,000. According to analyses done by All About Windows Phone, the Taj Mahal of tiles has seen developers submit just over 50,000 applications for review -- 42,655 of which are currently available in the United States. What may be more telling is the rate at which developers are submitting their wares. Over 17,000 apps have been submitted to the Marketplace in the last 90-days from over 13,000 different publishers (an average of 265 per day). With Apple's iOS App Store and Google's Android Market sitting firmly atop the mobile-app-ecosystem totem pole, Microsoft is looking to close the gap and put distance between itself and Research In Motion's BlackBerry App World. Hopefully, the gang from Redmond can keep the positive momentum going through 2012... even with its next major mobile OS revision being a minor one.

Bieber, Aguilera & Hudson Rock Disney Parks Christmas Day Parade

Making for an entertaining afternoon of holiday television, the 28th annual Disney Parks Christmas Day Parade offered up a star-studded lineup of performers during it's telecast on Sunday (December 25).

Hosted by Nick Cannon, the pre-taped Disney extravaganza welcomed teen sensation Justin Bieber to the Magic Kingdom park stage in Lake Buena Vista for renditions of his festive tunes "Mistletoe" and "Santa Claus is Coming to Town".

Also showing off her talents in the Lake Buena Vista locale was "American Idol" alum Jennifer Hudson, as the 30-year-old was backed up by a full choral group during a medley of holiday hits.

On the other coast of the States, Christina Aguilera joined alongside Minnie Mouse as she belted out ?Have Yourself A Merry Little Christmas? to the delight of the Disney Grand Californian Hotel & Spa crowd lining the stage in Anaheim, CA.

GRAPEVINE, Texas (AP) - Police say the seven people who were?found shot to death in a Dallas-area?apartment today had apparently?opened their Christmas gifts and had started cleaning up the?wrapping paper when they were shot.

Authorities say the seven people are believed to have been?related. They think the shooter was?among them.

Police in Grapevine say the four women and three men, ages 18 to?60, were found in an adjoining?kitchen and living room. Police went?to the apartment after receiving a 911 call and hearing nothing.

Two handguns were found near the bodies.

The apartment had been decorated for Christmas, with a tree.

Japan's PM reaches out to China on North Korea (AP)

BEIJING ? Japanese Prime Minister Yoshihiko Noda wrapped up a trip to Beijing on Monday where he sought China's cooperation in promoting stability in North Korea after the death of its longtime leader Kim Jong Il.

Noda's first official visit to Beijing since taking power in September would normally have centered on bilateral issues, such as squabbles over islands claimed by both countries, but the death of Kim on Dec. 17 and the announcement of his son Kim Jong Un as the country's "supreme leader" has shifted the focus.

Noda, the first foreign leader to meet with China's leaders since Kim's death, emphasized the need to get stalled six-party talks on North Korea's nuclear weapons program back on track.

"Strengthening our countries' relations is necessary in order to solve regional and global issues," Noda said when he met President Hu Jintao on Monday, a day after holding talks with his counterpart, Wen Jiabao.

On Sunday, Noda pointed to the new situation in East Asia, saying "it is very timely to exchange views with the host of the six-party talks and the country with the most influence on North Korea," referring to China.

His visit to China was planned before Kim's death was announced Dec. 19.

When asked whether China could confirm that Kim Jong Un was in complete control of North Korea, Japanese Foreign Ministry press secretary Yutaka Yokoi would say only that Noda and Wen had discussed the situation on the Korean peninsula.

After meeting with Wen, Noda told reporters that the two leaders had agreed to cooperate to try to achieve stability on the peninsula.

"We shared the understanding that denuclearization of the Korean peninsula and its peace and stability not only benefits Japan and China but serves the common interest of all neighboring countries," said Noda.

Yokoi said that a Chinese leader has been invited to visit Japan in the first half of next year, but would not say who.

Japan does not have diplomatic relations with North Korea, while China is the impoverished country's most important supporter and supplies it with food aid and much of its energy resources.

The six-party talks, which include the two Koreas, the United States and Russia, as well as China and Japan, are aimed at disarming North Korea of its nuclear capability. Pyongyang walked out on the talks in 2009 ? and exploded a second nuclear-test device ? but now wants to re-engage.

Last year, North Korea was blamed for two military attacks on South Korea that heightened tensions on the peninsula.

Yokoi said China would consider Noda's request to lease pandas for a zoo in Sendai to help cheer up the northern Japanese region as it recovers from the earthquake and tsunami disasters in March.

Noda and Wen noted that 2012 marks the 40th anniversary of the establishment of diplomatic ties between their countries and said both nations want to improve relations to mark that occasion.

Officials from both countries also signed memorandums of understanding on youth exchanges and setting up a clean energy and environmental protection investment fund.

Japan and China have a list of sensitive topics they are trying to make progress on, including fights over islands and energy disputes in the East China Sea.

Pilot error may have caused Iran drone crash (Reuters)

WASHINGTON (Reuters) ? The United States is investigating a combination of pilot error and mechanical failure as possible causes for the crash of a classified U.S. drone in Iran and does not believe Iran brought down the plane, according to two U.S. government officials.

The unmanned RQ-170 Sentinel drone, which had been on a sensitive CIA surveillance mission over Iran, crashed and was apparently reassembled by Iran before being put on display in Tehran, said one of the officials, who was speaking on condition of anonymity given the sensitive nature of the investigation.

While exactly what went wrong with the aircraft is not publicly known, it is now becoming clear that its operators could have crashed the plane and destroyed it if they had taken action while it was still at a higher altitude, according to a source familiar with the aircraft and its operation.

Instead, the stealthy drone built by Lockheed Martin Corp broke up into several large pieces, allowing Iran to reassemble the plane and possibly share some of its technological secrets with China, Russia or other U.S. competitors.

Once the plane, built by Lockheed Martin Corp, dropped to a low enough altitude, its aerodynamic design made a catastrophic crash impossible, said one person familiar with the plane's design and operating procedures.

Pilot error has not been confirmed, but it is one of the causes under examination, according to the two officials.

The new information explains why the drone was not destroyed and instead fell into Iran's hands in an incident that has significantly heightened tensions with the United States.

Iran announced on December 4 it had downed the spy plane in the eastern part of the country, near Afghanistan. It has since shown an image of the apparently intact plane on television and said it is close to cracking its technological secrets.

Iranian officials have variously claimed they shot the plane down, or duped it into landing by resetting its navigational information.

The incident was the latest in a series that have escalated a confrontation between Iran and the West, which accuses the Islamic Republic of trying to develop nuclear weapons. Iran denies that charge.

U.S. President Barack Obama has asked Iran to return the drone, but Iranian officials say they do not plan to give it back.

U.S. officials, speaking on condition of anonymity, have confirmed the plane was on a CIA surveillance mission over Iran, but adamantly deny Iran shot it down, or brought it down through computer hacking.

Early on, officials said it likely suffered a technical malfunction, but this is the first time officials have raised the possibility of pilot error.

Lockheed has confirmed it makes the RQ-170 drone, which came out of its secretive Skunk Works facility in southern California, but is referring all questions about the current incident to the Air Force, which first acknowledged the existence of the drone in December 2009.

The plane measures over 40 feet from wing tip to wing tip, and carries a full-motion video sensor that was used this year by U.S. intelligence to monitor al Qaeda leader Osama bin Laden's compound in Pakistan ahead of the raid that killed him.

The main concern about technology Iran could pilfer from the drone centers on special coatings on the craft's surface that make it largely invisible to radar.

The computers onboard the drone are believed to have been heavily encrypted and its sensors were not the most sophisticated tools in the U.S. arsenal.

The United States and other Western nations tightened sanctions on Iran last week and Britain withdrew its diplomatic staff from Tehran after hard-line youths stormed two diplomatic compounds.

The United States has not ruled out military action against Iran's nuclear facilities if diplomacy fails to resolve a dispute over the program, which Washington believes is aimed at developing atomic weapons.

Agencies face budget curbs in $1 trillion bill (AP)

WASHINGTON ? Facing a weekend deadline to avoid a government shutdown, a combative Congress appears on track to advance a massive $1 trillion-plus yearend spending package that curbs agency budgets but drops many policy provisions sought by GOP conservatives.

Lawmakers reached a tentative agreement Monday on the measure. It chips away at the Pentagon budget, foreign aid and environmental spending but boosts funding for veterans programs and modernizing the U.S. nuclear arsenal.

The measure generally pleases environmentalists, who succeeded in stopping industry forces from blocking new clean air rules and a new clean water regulation opposed by mountaintop removal mining interests. House Republicans appeared likely to win concessions that would roll back administration efforts to ease restrictions on Cuban immigrants on traveling to the island and sending cash back to family members there.

On spending, the measure implements this summer's hard-fought budget pact between President Barack Obama and Republican leaders. That deal essentially freezes agency budgets, on average, at levels for the recently completed budget year that were approved back in April.

Drafted behind closed doors, the proposed bill would provide $115 billion for overseas security operations in Afghanistan and Iraq but give the Pentagon just a 1 percent boost in annual spending not directly related to the wars. The Environmental Protection Agency's budget would be cut by 3.5 percent. Foreign aid spending would drop and House lawmakers would absorb a 6 percent cut to their office budgets.

The bill also covers money for combating AIDS and famine in Africa, patrolling the U.S.-Mexico border, operating national parks and boosting veterans' health care.

House Appropriations Committee Chairman Harold Rogers, R-Ky., said bargainers had struck an agreement but would not formally unveil it until Tuesday. Other lawmakers said some issues remain to be finalized.

A House vote is expected Thursday and the Senate is likely to follow in time to meet a midnight Friday deadline before a stopgap funding measure expires.

The generally smooth, businesslike negotiations on the omnibus spending bill contrast with the ongoing partisan brawl over Obama's demand that Congress extend jobless benefits and a cut in the Social Security payroll tax. The House is slated to vote on a GOP-friendly version of the payroll tax cut Tuesday; negotiations with the Democratic-controlled Senate on a compromise measure have yet to begin.

The delay into Tuesday on the spending measure stemmed in large part from displeasure on the part of Senate Democratic leaders, upset about the hard line taken by Republicans on the payroll tax cut measure. Democrats are seeking to ensure both the spending measure and the payroll tax bill pass before Congress adjourns for the year.

"They're connected politically. We need to do it all before we go home," said Sen. Dick Durbin, D-Ill.

Rogers was pushing until the end to block clean water rules opposed by mining companies that blast the tops off mountains, to no avail. Top Appropriations Committee Democrat Norm Dicks of Washington, when asked if the mountaintop mining rider was still a concern, said, "It would be if it were in" the final legislation.

Dicks also predicted failure for several GOP attempts to block the EPA's authority to issue greenhouse gas regulations and new limits on hazardous emissions under the Clean Air Act.

House GOP leaders pressed riders to block the Obama administration's 2009 policy lifting restrictions on travel and money transfers by Cuban-Americans to families remaining in Cuba, and some Democrats backing the administration policy seemed resigned to defeat.

On spending, the measure generally consists of relatively small adjustments to thousands of individual programs. Agencies like the Border Patrol and Immigration and Customs Enforcement will get a boost within the Homeland Security Department, while GOP defense hawks won additional funding to modernize the U.S. nuclear weapons arsenal. The troubled, over-budget, next-generation F-35 fighter plane program would be largely protected.

Democrats won a modest increase in funding for schools with large numbers of disadvantaged students.
